Supreme Court of Canada, June 16, 1997
Opening statements, Delgamuukw hearing

Supreme Court Judge: Delgamuukw AKA Earl Muldoe pursuing on his own behalf and on behalf of all the members of the House of Delgamuukw and others versus Her Majesty the Queen in right of the province of British Columbia and others.

Stuart Rush, Gitxsan legal team: I’d like to begin my submissions by this introduction. This case arose from the Gitxsan chiefs’ efforts to for over a century to obtain justice and the return of their land... And so 19 years after the 1977 application, still no negotiations and no treaty… The Gitxsan people have a long and very deep history on their homelands. Their system links every part of their society to that land. It is integrated on its own terms. It has its own customs, its own laws, its own traditions. It’s distinctive.
